1. Acceptance of Terms

By accessing or using the Rhinua mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Rhinua provides a mobile application that uses ARKit facial scanning technology to capture nasal measurements and calculate the geometry needed to create custom 3D-printed nasal dilators. The App facilitates orders for custom medical devices manufactured from medical-grade PA12 material.

3. Medical Device Disclaimer

The nasal dilators produced through our service are Class I medical devices. By using this App, you acknowledge that:

• This product is not intended to diagnose, treat, cure, or prevent any disease
• You should consult with a healthcare provider before using any medical device
• Individual results may vary
• The product is for personal use only
• You are solely responsible for determining whether this product is appropriate for your needs

4. Eligibility

You must be at least 18 years old to use this App and order products. By using the App, you represent and warrant that you meet this age requirement.

5. Account Registration

To use certain features of the App, you must create an account using Apple or Google authentication. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

Account authentication is handled through Firebase. We do not store your login credentials directly.

6. Facial Scanning and Biometric Data

When you use the App's scanning feature:

• ARKit technology captures your facial structure to measure nasal dimensions
• Measurements are calculated and used solely to manufacture your custom device
• We do not store facial images or raw biometric data
• Only the calculated geometric measurements are retained for order fulfillment
• Measurement data sent to our business email is automatically deleted after 30 days
• You consent to this data collection and processing by using the scanning feature

7. Orders and Payment

• Each scan can be submitted as a one-time order for a custom nasal dilator
• Payment processing is handled securely through Stripe
• We do not store your payment information
• All sales are final once manufacturing begins
• Order information is stored in Firebase for fulfillment purposes only

8. Manufacturing and Shipping

• Products are manufactured by third-party 3D printing services using medical-grade PA12 material
• Manufacturing typically takes 5 business days
• Shipping times vary based on your location
• We are not responsible for delays caused by third-party manufacturers or shipping carriers

9. Returns and Refunds

Due to the custom nature of our products:

• Returns are only accepted for defective or damaged products
• Refund requests must be made within 10 days of delivery
• You must provide photographic evidence of defects
• Custom-manufactured products cannot be returned for sizing issues after production begins

10. Privacy and Data Storage

• We store only order information in Firebase
• No payment information is stored on our servers
• Facial scan data is not stored; only calculated measurements are retained
• Measurement data is automatically deleted from our email after 30 days

11. Intellectual Property

All content, features, and functionality of the App are owned by Rhinua and are protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute any part of the App
• Reverse engineer or attempt to extract source code
• Use the App for any commercial purpose without permission

12. Prohibited Uses

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to any systems
• Submit fraudulent orders or payment information
• Scan or order devices for anyone other than yourself
• Resell or distribute products commercially
• Interfere with or disrupt the App's functionality

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Rhinua is not liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid for your order
• We do not guarantee that the App will be error-free or uninterrupted
• We are not responsible for third-party manufacturing or shipping issues

14. Medical Disclaimer and Assumption of Risk

You acknowledge and agree that:

• Nasal dilators may not be suitable for everyone
• You assume all risks associated with using the product
• We are not responsible for any adverse reactions or complications
• You should discontinue use and consult a doctor if you experience any problems
• This product is not a substitute for professional medical advice

15. Indemnification

You agree to indemnify and hold harmless Rhinua, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the App or products
• Your violation of these Terms
• Your violation of any rights of another party

16. Third-Party Services

Our App uses third-party services including:

• Firebase (authentication and data storage)
• Stripe (payment processing)
• SendGrid/Railway (email delivery)
• Third-party 3D printing services

Your use of these services is subject to their respective terms and privacy policies.

17. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the App. Your continued use of the App after changes constitutes acceptance of the modified Terms.

18. Termination

We may terminate or suspend your account and access to the App at any time, without notice, for:

• Violation of these Terms
• Fraudulent activity
• Any other reason at our sole discretion

19. Governing Law

These Terms are governed by the laws of South Carolina, without regard to conflict of law principles. Any disputes shall be resolved in the courts of South Carolina.

20. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
